Terms of Use
Multi Axis Games, LLC, Port Angeles, Washington, USA, is a private limited liability company, registered in Washington State, hereafter referred to as "MxG" 

Taking into consideration that:

MxG provides the online browser based game Brunelleschi: Age of Architects (hereafter referred to as "Brun" or "the game") on www.brungame.com and via www.facebook.com/brunelleschi
All services on www.brungame.com and related (sub)domains and through www.facebook.com/brunelleschi are subject to these terms and conditions.

1 Definitions
If names and concepts in these terms are written with a capital letter, they have the following meanings: 

"Services" include, but not limited to the provision of sites with the game Brun. The Conditions apply to these services;
"End User" person who registers to participate in the game. The terms end user, user and player are interchangeable;
"Inactive Users" End users who have not logged in to the Game for a period of 14 days;
"Registration" access to the Game after the registration of the necessary personal data and acceptance of the Terms by the End User;
"Sites" webpages on www.Brun.com and all related (sub)domains and via www.facebook.com/brunelleschi;
"Game" the online browser-based game Brun which is made available on the Sites;
"Rules" the rules set by MxG on playing the Game;
"Conditions" these terms and conditions, including all attachments and considerations, and the Rules;
"Agreement" the terms and conditions, including all attachments and considerations, and the Rules;

2 General
Amendments to the Terms will be published on the Sites. If these Terms are changed they will take effect 7 days after publication of the revised Terms on the Sites.
User agrees to read the Terms regularly to help ensure that the user is kept informed of changes within the Terms.
The Conditions are always available for the user by clicking on the link to the conditions at the bottom of the homepage of the Sites.
The User is deemed to accept the changes if the user will continue using the services 7 days after the revised conditions are published on the Sites. If the user does not accept one or all of the changes in the terms and conditions, the user has to unsubscribe to the services.

3 Services
Users may use all - whether they are free or not - offered functions of the Sites, but can reserve no rights to this use.
MxG reserves the right to change the Services at any time without any giving reason. MxG will properly inform the Users of the Game if it changes the Services.
MxG reserves the right to, at any time without giving any reason, temporarily or permanently, shut down the Sites without any prior warning.
MxG reserves the right to change the information mentioned above, including, but not limited to graphics, text and links to other sites on the Sites, without prior notice or reason.
Although the maintenance / preparation of the Sites the utmost care is exercised, there is always the possibility that information, including, but not limited to graphics, text and links to other sites, on the Sites, are outdated or no longer correct. MxG is not liable for any inaccuracies or consequences of activities undertaken on the basis of the information on the Sites.
Despite all care being exercised in the management of data from Users is possible that a User will not receive information and / or offers from MxG while the User may have limited and / or banned access to the Sites. Persons to whom this applies, can reserve no rights to information or offers on the sites or in newsletters offered by MxG.

4 Liability
MxG is in the context of the establishment and / or execution of the Terms not liable for any damages arising from a (culpable) deficiency, tort or otherwise.
MxG can not be held responsible for the reinstantiation of a membership after an error has occurred.
MxG can not be held liable for the content of communications between Users.
The Sites may contain links to external web sites. These web sites are not the responsibility of MxG and MxG can not be held responsible for the content and operation of these sites, nor for their Terms of Use and / or privacy policies.

5 Intellectual property
The End User is not allowed any to delete, modify or reproduce any content of the Sites or other rights of intellectual or industrial property of MxG or its licensors or suppliers, without the written consent of MxG.
All rights of intellectual or industrial property to the Service(s) lie solely at MxG or its licensors or suppliers.

6 Registration
After Registration there is a legal agreement between MxG and the user. The Registration is free. The User can not entitle any legal rights regarding the Registration.
No User has a legal right to register. MxG reserves the right to refuse, delete, block or modify records of users without giving any reason.
MxG reserves the right to delete Inactive Users and their records.

7 Obligations of the End User
The User commits itself to keeping its communication with other users free of discriminatory, racist, pornographic and otherwise offensive or illegal content.
The User is committed to choose his or her game name / alias in a way that there is no discriminatory, racist, pornographic or any other aggressive connotation.
The User is only allowed to connect to the Game and / or the Sites via a standard Internet Browser. Any other way to play and / or to access the Sites through other programs or so-called scripts are explicitly prohibited.
It is forbidden for the User to use errors in the software of the Game, including but not limited to bugs, to the its own advantage.
It is forbidden for the User to attempt to reverse-engineer the Game.
Breach of clause 7 may immediately lead to blocking or deleting of the Registration by MxG, whose decision in this is binding and final.
The User is responsible to keep his or her password safe. It is recommended to change the password regularly.

8 Data protection 
MxG shall process no more personal data of the End User than necessary for a good supply of the Services.
MxG processesd personal and traffic data for:
market research, marketing and (direct) marketing for the work and / or services of MxG and / or other related companies, provided that the End User has given its consent;
billing;
traffic management;
If the User objects to the aforementioned use of personal data, he or she may announce this at any time to MxG in writing.
MxG shall honor legal obligations to provide information, including personal data.
MxG may, for carrying out the terms and conditions, use financial services from third parties. In this context, data from the End User (with the consent of the End User) can be provided to such third parties. MxG is not liable for the use by third parties of data from End Users.
At the end of a registration by the End User or the deltion of a Registration by MxG, MxG is required to remove all data from the User within 120 hours, except when it is legally enforced that this data shall not be removed.
By accepting the Terms, the User agrees that MxG may send him or her e-mails to inform about new products, services and any other information which MxG considers that such an e-mail could be of use for the End User. If the End User does not wish to receive this information it can state so in an e-mail to info@brungame.com with the subject "STOP NEWSLETTER".

9 Force Majeure
MxG is not obliged to fulfill any obligation to the End User, if MxG is prevented from doing so due to a circumstance that can not be attributed to MxGs debt ("force majeure").
Circumstances referred to in the preceding paragraph include, but are not limited to: interference in the connections and the Internet, malfunctions in the energy and material supply, transport delays, strikes, lock-outs, government measures, the carriers, suppliers and / or other third parties failing to fulfill their obligations.

10 Final rules and regulations 
On the Sites and the Terms, the State of Washington law applies. All disputes arising out of or in connection with these terms and conditions will only be submitted to a competent court in the State of Washington.
Jurisdiction for all legal disputes is the seat of establishment of MxG.
This Agreement between User and MxG can only be amended by means of a written agreement signed by both MxG and the End User.
If any part of this Agreement is invalid, not binding and / or unenforceable, this has no effect on the rest of the agreement, which remains valid and enforceable under the applicable provisions.
